These Terms and Conditions ("Terms") govern your access to and use of efhdfoundation.com (the "Site"), operated by EFHD Foundation ("EFHD," "we," "us," or "our"). By accessing or using the Site, subscribing to our updates, attending an EFHD event, or making a donation through the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

EFHD is a nonprofit foundation created to fund Huntington's Disease (HD) research, support the HD community, and raise awareness of HD. Nothing in these Terms is intended to create any obligation on EFHD's part beyond what is expressly stated here.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law or regulation;
• Attempt to gain unauthorized access to the Site, its servers, or any systems or networks connected to the Site;
• Interfere with or disrupt the operation of the Site, or introduce viruses, malware, or other harmful code;
• Scrape, harvest, or collect information about other users or visitors without their consent;
• Impersonate any person or entity, or misrepresent your affiliation with EFHD.

We may suspend or restrict your access to the Site at any time, in our discretion, including if we believe you have violated these Terms.

3. Intellectual Property

The Site and its content — including text, graphics, logos, the EFHD name and marks, images, and design — are owned by EFHD or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and share content from the Site for personal, non-commercial purposes, but you may not reproduce, modify, distribute, or create derivative works from the Site's content without our prior written permission, except as permitted by applicable law.

4. Newsletter and Communications

If you sign up through "Stay close" or otherwise provide your contact information, you agree that EFHD may send you email communications about our mission, research funding, community support, and events. You may unsubscribe at any time using the link in our emails or by contacting us. See our Privacy Policy for more information about how we handle your information.

5. Health and Educational Content Disclaimer

The Site includes general educational information about Huntington's Disease. This information is provided for general awareness purposes only and is not, and should not be treated as, medical advice, diagnosis, or treatment. Always consult a qualified physician or other healthcare provider with any questions you may have regarding a medical condition, including HD, its genetic testing, symptoms, or treatment options. Reliance on any information on the Site is solely at your own risk.

6. Donations

If you make a donation to EFHD through the Site, you represent that you are authorized to use the payment method provided and that the information you provide is accurate. Donations are generally non-refundable except as required by law or as EFHD may determine in its sole discretion.

7. Events and Tickets

Event details published on the Site, including dates, venues, and performers, are subject to change without notice. If tickets are purchased through the Site, all sales are final except as required by law or as otherwise stated at the time of purchase. EFHD is not responsible for the acts or omissions of venues, performers, or third-party ticketing providers.

8. Third-Party Links

The Site may contain links to third-party websites and social media platforms, such as Instagram, that are not owned or controlled by EFHD. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of any third-party site is at your own risk and subject to that site's own terms.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. EFHD DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE SITE, INCLUDING INFORMATION ABOUT HUNTINGTON'S DISEASE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EFHD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF EFHD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, EFHD'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EFHD, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless EFHD and its officers, directors, employees, and volunteers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site.

12. Dispute Resolution; Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Virginia, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Effective date" above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

14. Severability; No Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. EFHD's failure to enforce any provision of these Terms will not be considered a waiver of that provision.
